Unmarried families

Cohabitation is a completely informal relationship which has no specific legal responsibilities unless you own property together. In England and Wales there is no legal relationship known as a “common law husband or wife”. When this has been misunderstood and the relationship breaks down the process of unravelling the financial contributions and property ownership can be very complicated. Our team has in-depth knowledge and understanding of the highly complex and changing legal framework which governs these disputes. We will help you resolve property disputes in a fair and cost effective way.
It is advisable to consider reaching an agreement with your partner as to how you wish to hold the assets prior to cohabitation. We can help you draft a cohabitation agreement which, in the event of future relationship breakdown, can help to reduce conflict.

If you are unmarried and have children then your legal rights for financial support on relationship breakdown are very different to that of married parents. If you are the carer of your child you will need a home and regular financial support after separation. You may need payment of school fees and other child related expenses. We have a wealth of experience in this area and can advise and guide you through this process. The court’s first consideration in these cases is the welfare of the children. The court will take the financial circumstances of both parties into account and decide how best your children can be financially supported whilst they are dependant.

International / Where to Divorce
