Successful appeal helps clarify what amounts to notice to end an adoption placement

Jemma Dally of Goodman Ray represented the prospective adopters who succeeded in their appeal in the recently reported Court of Appeal case of Prospective Adopters v Sheffield City Council [2020] EWCA Civ 1591. The Times law report for the case can be found here.

 

The prospective adopters successfully appealed an earlier decision made by the Court to strike out their application to adopt a child who had previously been placed for adoption with them.

 

The case has helped to clarify uncertainty in the law around exactly what constitutes adequate notice from prospective adopters that they wish to withdraw from a plan to adopt a child.
