What is Divorce?
Whilst Divorce can refer to the process of legally dissolving a marriage, more broadly it involves resolving broader issues arising from separation, including financial issues, child arrangements, and what form of dispute resolution or non-court dispute resolution you are going to use to help you reach a settlement.
Prior to April 2022, individuals applying for divorce were required to make a single joint application and to make a choice between various grounds to justify the divorce. However, with the introduction of the no fault divorce process in April 2022, the need to assign blame was removed. Under this new system, the only ground for divorce is that the marriage has broken down irretrievably, and no further proof or justification is required. Both parties are also now able to make a joint application, minimising costs and promoting an amicable approach to the divorce process.
It is, however, important to note that getting a divorce is not a quick process. There is a period of 20 weeks from starting the divorce to the point at which you can ask the Court for the interim stage in the process known as a “Conditional Order” and at least 6 weeks after that before the “Final Order” can be made (although this may be longer to leave time for financial matters to be resolved). Although a divorce can be relatively straightforward, difficulties can arise when considering the division of finances and child arrangements, issues which our team of solicitors are highly experienced in handling.
