Surrogacy is an arrangement between two people who want to parent a child and a woman who agrees to carry and give birth to that child. Under English law the surrogate mother remains the legal mother, wherever the child was conceived and/or born, unless orders are made to the contrary by the court. These orders are known as “parental orders”. They give the intended parents legal parental rights and ends those of the surrogate mother. Once a parental order is made a new birth certificate naming the intended parents will be issued to replace the first birth certificate.
